NZBA considers that the introduction of a statutory notification regime is a welcome addition to the Commerce Act. However, we submit that the scope of the regime is too narrow, and that the process is too lengthy to enable time-sensitive collaborative activities. We also believe the proposed expansion of the Commerce Commission’s discretion is unnecessary, as existing tools are adequate to address the concerns identified.
